There seems to be no end to the troubles that Raj Kundra has been facing ever since he has been arrested in the alleged pornography case. The Bombay High Court had also deferred hearing on a plea submitted by Ra Kundra and alleged that his arrest in the case was illegal as he was not served legal notice according to the law.
Earlier, Raj Kundra along with his business assistant Ryan Thorpe sought interim bail pending hearing of his plea seeking quashing of the case. According to reports, Mumbai Police informed HC that 51 pornographic movies have been seized from the accused that included cellphones, storage devices, and material from personal laptops as the accused were reportedly streaming porn on mobile app HotShots and Bollyfame.
The reason why Raj Kundra and Ryan got arrested was that they had begun to delete their WhatsApp group and chats and they were on the path of destroying evidence. Therefore, the police had to arrest them. At the time when they were supposed to cooperate, they decided to delete content from WhatsAppgroups and chats.
And, when an accused begins to damage the evidence the investigating authority cannot remain mute spectators, they must prevent them from doing it. In an effort to prevent them, they were arrested, Public Prosecutor Aruna Paitold Bombay High Court on Saturday, appearing for Mumbai Police.
Mumbai Police also recovered a message from Raj Kundra’sbrother-in-law Pradeep Bakshi, who happens to the owner of Kenrin Private Limited in the UK and named as a wanted accused in the pornography case, added Aruna Pai. According to police, Kenrin was the owner of Hotshots in which pornographic content was uploaded.
The police maintained that Kundra, Thorpe, his IT technician were appropriately served notice under Section 41A authorizing his appearance before a police officer to evade unnecessary arrest of CrPC. Thorpe had accepted the notice and Raj did not accept it.
Aruna Pai informed that a new charge section 201 under IPC was added against the accused (punishment for causing disappearance of evidence). Now the HC has posted the matter for physical hearing on Monday.
Meanwhile, senior lawyer Aabad Ponda representing Rah Kundra had informed the court if police notice was not acknowledged by Raj Kundra, in accordance to criminal procedure, the investigating officer was supposed to seek an order from the magistrate to arrest the petitioner, which failed to be done. Advocate Abhinav Chandrachud appearing for Raj’sbrother in law Thorpe has alleged that when his client had fulfilled with the police notice, his arrest remains illegal.
Raj Kundra’s associate Yash Thakur said he was framed because he did not agree to pay the extortion money. He has also denied all the charges leveled against him by Mumbai Police. He has reportedly sent a letter to Mumbai Police in which he has alleged that he is a victim of extortion.
Meanwhile Hansal Mehta and Richa Chadha have come out in support of Shilpa Shetty. Richa Chadha said that she is glad that Shilpa Shetty is suing. The actress has criticized those blaming women for the mistakes of men.
Earlier, Bombay High Court on July 30 heard Shilpa Shetty’spetition as she had filed a defamation case against media houses for reportedly spoiling her image after her husband Raj Kundra’sarrest in the alleged pornography case. Shilpa reportedly broke down during the hearing. Shilpa’s lawyer claimed that some journalists did not try to find Shilpa’s side of the story.
However, the court said that reporting based on police sources cannot be defamatory. Bombay High Court also noted that passing a blanket gag order on media against reporting anything against the actress may have chilling impact on the freedom of press.
